These general terms and conditions regulate the acquisition of the products and services offered on the website www.cardeno.es (hereinafter the website), owned by CARDENO SL, with registered address at Calle Matadero, 11, 06280, Fuentes de León, Badajoz, Spain, with Spanish national tax id. no. NIF B6023055, which markets its products and services under the trade name CARDENO (hereinafter THE PROVIDER). The company is registered in the Companies Register of Badajoz, folio 1, volume 67, 3rd section, sheet 1884, first registration.

It also regulates the rights and obligations of the parties arising from the sales transactions concluded between them.

Anyone accessing this website assumes the role of user (hereinafter THE USER), the acquisition of any of the products or services entails the full and unreserved acceptance of each and every one of the General Terms and Conditions indicated without prejudice to the acceptance of the Special Terms and Conditions that may be applicable when acquiring certain products or services.

Acceptance of the purchase by THE USER implies the declaration of their willingness to purchase our products or services and gives full effect to the sales contract signed between the parties.

These General Terms and Conditions may be modified at any time without prior notice; therefore, it is recommended that you read their contents carefully before purchasing any of the products or services offered and save or print them by clicking the following link:

All notifications and communications between THE USER and THE PROVIDER shall be considered effective, for all purposes, when they are made by any of the aforementioned means.

PRODUCTS AND SERVICES

The products and services offered, along with their main characteristics and prices, are displayed on the screen.

THE PROVIDER reserves the right to determine which products and services are offered to THE USER at any given time. THE PROVIDER may at any time add new products or services to those currently offered. Furthermore, THE PROVIDER reserves the right to withdraw or cease to offer at any time and without prior notice any of the products or services offered.

Once inside the website and in order to purchase the different products or services, the USER must follow all the instructions indicated in the purchase process.

 

The availability, description and price of each article can be consulted on the product or service sheet and are valid unless the product is out of stock or there is a typographical error.

PURCHASE PROCESS

In order to make any purchase on the website, THE USER must be of legal age and have the capacity to contract.

 

 

It shall also be necessary to register by means of a data collection form in which THE USER provides THE PROVIDER with all the information necessary for the purchase; this data must always be truthful, accurate and complete with regards to their identity and THE USER must expressly provide consent by accepting our Privacy Policy.

To correct any errors in your data, you can access your user file using the username and password provided/chosen and proceed to correct it.

The steps to make a purchase are indicated below:

 

  1. Select the products or services.
  2. Click the button “add to basket”.
  3. Confirm your order.
  4. Register if you haven’t done so already. (You shall receive confirmation to email address indicated)
  5. Choose the delivery method.
  6. Choose the payment method.
  7. Click “accept” if all the information is correct and follow the instructions depending on the payment method.

THE PROVIDER shall store the order electronically and it shall be available to you in your control panel, which you may access at any time using the username and password provided/chosen during the registration process.

It is recommended that THE USER prints and/or saves a permanent copy of the proof of receipt that they receive by the email indicated in the registration process immediately after confirming their purchase.

INVOICING

If requested, you shall receive the corresponding invoice along with your order. It shall be sent by default to the email address provided during the registration process.

PRODUCT DELIVERY

Your order shall be prepared for dispatch as soon as your payment has been confirmed, and shall be available for dispatch within 24 hours at the latest (working days, excluding Saturdays, Sundays and public holidays). If you require confirmation of delivery, please do not hesitate to request it. Products that require special processing, such as slicing and boning, may take an additional 24/48 hours to be prepared for shipment.

Transit times depend on the location of the delivery address indicated by the user. This period (from receipt of confirmation of payment) shall be approximately that indicated in the purchase process and more specifically:

 

Mainland Spain: from 1 to 3 days.

Balearic islands: from 2 to 5 days.

France, Germany, Italy, Belgium, United Kingdom, Holland, Luxemburg and Austria: from 4 to 8 days.

Ireland, Northern Ireland and the rest of the European Union (excluding islands): from 4 to 9 days.

If when you receive our order at your home you notice that the packaging is broken or damaged, you must check that the items inside are in perfect condition and are not broken or deteriorated, in any case indicating this on the delivery note of the goods as a comment.

If they arrive damaged or broken due to transport, you must notify the courier of the transport company and they must also specify this on the delivery note.

THE PROVIDER guarantees that all its products are shipped from our warehouse in perfect condition and the packaging is free of defects. If any of the two circumstances mentioned above occur (delivery defects), you must notify us so that we can claim the damage caused from the transport insurance and examine the case. In any of these cases, you may choose to exchange the product or to receive a refund of the amounts paid.

If receipt of orders is delayed beyond the contracted time due to causes attributable to the transport company, THE PROVIDER shall not be held responsible for this delay, with the transport company being held responsible in all cases.

THE PROVIDER shall not be held responsible for delays caused as a result of acts beyond its control, which may include, among others, weather conditions, strikes, blockades, customs incidents, force majeure. If we are aware of such delays or they can be foreseen, we shall notify you as soon as possible.

 

ORDER TRACKING

It is essential to provide a valid email address to track the order, as the transport companies shall send a tracking number to this email address along with the web address or URL where you can track the order’s location.

By default we shall always use the email address indicated in the registration process.

 

PRODUCT AVAILABILITY AND SUBSTITUTION

 

THE PROVIDER undertakes to guarantee the availability of all products advertised. However, in the event that any product ordered is not available or if the product is out of stock due to exceptional circumstances of an interactive multi-order or any other circumstances that cause the product to be out of stock, THE USER may choose to:

  • Purchase a similar product.
  • Wait until the product is back in stock.
  • Receive a refund of the amount paid, if applicable.

In the latter case, the order and the contract signed between the parties shall be terminated by virtue of this termination clause, and the amounts paid by the customer in the event of prepayment shall be fully refunded to them, without any compensation being payable to either party for breach of contract, consequential damages or loss of profit, nor shall the payment made by the customer be understood as a penalty deposit.

Orders shall be cancelled in any of the following cases

 

  • Delivery cannot be made if three attempts at delivery have been made.
  • It was not possible to contact the customer within 9 working days after the first unsuccessful delivery attempt.
  • The order amount has not been transferred within ten working days of the order date.

Users who place cash on delivery orders that are not picked up and are returned by the carrier for no reason shall be unable to make any further purchases through this website.

 

PRICES, FEES AND TAXES

The prices of the products or services indicated on the website include the VAT in force at the time of purchase.

When the order is placed, they shall be added and itemised. In any case, the invoice received by the customer shall clearly indicate the taxable amount, the tax rate, the total tax amount, any other charges such as transport or additional fees for the method of payment to be paid as well as the invoice total.

Orders shall be processed in strict order of receipt.

Delivery fees depend on the destination, the volume and weight of the order, as well as the urgency of the delivery.

However, before confirming the order, this information shall be displayed and the corresponding invoice shall be itemised.

PAYMENT METHODS

The following payment methods are available:

a) By credit card, Visa, Mastercard or Euro6000; all you have to do is provide us with your card number and expiry date. In this case, your data shall be encrypted and sent under secure server to our bank’s POS. If any refund or cancellation of the order is necessary, the amount shall be refunded to the same payment card.

1. b) By bank transfer in favour of CARDENO SL. The transfer must be made within a maximum period of 5 working days after the order has been placed. If no confirmation of the transfer is received after this period, the order shall be cancelled.

The order shall not be considered confirmed until you send the scanned transfer receipt to our email atencionweb@cardeno.es and/or we verify that our bank has made the payment.

1.     c) PayPal, a US e-commerce company, is an alternative to traditional paper-based methods such as cheques or money orders and allows users to transfer money by email.

2.     d) Cash on delivery (only for orders in mainland Spain). Cash on delivery (only for orders in mainland Spain). A 4% surcharge shall be added to the final cost.

 

RETURN AND WITHDRAWAL POLICY

According to the regulations in force, THE USER has the right to WITHDRAW from the contract for a maximum period of 14 calendar days (from the day of receipt and according to the official calendar of the place to which the goods have been delivered), without having to indicate the reason, through the logistics operator that supplied it and without incurring any cost, except those provided for in Art. 107.2 and 108 of RD1/2007, of 16th November, which approves the aforementioned text of the General Law for the Defence of Consumers and Users.

During this period, THE USER may inform THE PROVIDER of their decision to withdraw from the contract by filling in the form at the end of this document and sending it to the e-mail address provided in these general terms and conditions and may withhold the refund until they have received the products or proof of return.

THE USER must return the products within a maximum period of 14 calendar days from the date on which they communicated their decision to withdraw.

THE PROVIDER shall provide THE USER with a permanent acknowledgement of receipt of the withdrawal.

Withdrawal implies that THE PROVIDER shall proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days following the day after receiving the product (material delivery of the good) or having contracted the service, following the same procedure chosen for payment or through that indicated by THE USER.

THE USER must return the products within a maximum period of 14 calendar days from the date on which they communicated their decision to withdraw from the contract.

The products must be returned correctly protected and, if possible, in their original packaging.

Certain products are exempt from the right of withdrawal. However, if a product is faulty, CÁRDENO, S.L. shall replace it, whenever possible, at no cost to the customer. If, due to availability reasons, the product cannot be replaced, the purchase price and shipping costs shall be fully refunded.

If you have started eating your sliced ham, ham shoulder or whole sausage and it is not to your liking, you can also return it as long as you have not consumed more than 25% of the product, which is more than enough to check the quality and condition of the product.

If THE USER exercises the right of withdrawal, the cost of returning the goods shall be borne by us.

The relevant forms for exercising this right can be found at the end of this document.

WARRANTY

CÁRDENO, S.L. acts as manufacturer and guarantees that the products offered for sale on www.cardeno.es are free from defects or hidden faults that could render them dangerous or unsuitable for normal use.

If you believe that the information that appears on the products in our shop is insufficient, please ask us to provide you with more information by contacting our Customer Service department through the contact channels indicated herein.

 

CUSTOMER SERVICE AND CLAIMS

In order to lodge any complaint or claim with THE PROVIDER, THE USER must contact the customer service department through the contact channels indicated in these general terms and conditions.

An extrajudicial complaint mechanism provided for in Regulation (EU) No 524/2013 of the European Parliament and Council, of 21st May 2013, can be used and accessed via the following link:

The parties shall submit to the following courts and tribunals to settle any disputes that may arise between them, renouncing to any other jurisdiction.

If THE USER is a consumer, the courts and tribunals of the domicile of said user shall have jurisdiction.

If the buyer is an entrepreneur, the courts and tribunals closest to THE PROVIDER’s registered address shall have jurisdiction.

NULLITY AND INEFFECTIVENESS OF CLAUSES

If any clause included in these terms and conditions is declared fully or partially null and void or ineffective, such nullity shall only affect that provision or the part thereof which is null and void or ineffective, with the rest of the terms and conditions remaining in full force and effect.

PERIOD OF VALIDITY OF THESE TERMS AND CONDITIONS

The period of validity of these conditions is the time they remain published on the website and shall apply to products purchased at the time these terms and conditions are available.

 

In any case, THE PROVIDER reserves the right to modify them unilaterally, without this affecting the products contracted by THE USER prior to the modification.

 

APPLICABLE LEGISLATION

These terms and conditions are governed by Spanish law. To resolve any doubt, discrepancy or divergence that may arise in the fulfilment or interpretation of this document, the courts and tribunals of the province of THE PROVIDER shall have jurisdiction.

The Spanish language is used for the formalisation of the contract.
